TERMS OF USE
This Agreement governs the use of services (the "Service") offered by MyVirtual Network L.L.C. ("MyVirtual Network") and the MyVirtualNet.com Web Site (the "Site"). Please read these Terms of Use before using or continuing to use the Site. Use of the Site constitutes an agreement to all terms and conditions in this Agreement. By using this Site you represent, warrant, understand, agree to and accept all terms and conditions contained in this Agreement without modification. If you object to anything in this Agreement, our Store Policy or Privacy Policy, do not use the Site or the Service. The Terms of Use are subject to change by MyVirtual Network at any time, and become effective upon posting on the Site. The revised version, and your use of the Service after such posting, will constitute acceptance by you of the revised version of the Terms of Use posted on this site.
GENERAL INFORMATION: Links from MyVirtualNet.com to other sites on the Web are the responsibility of the user to evaluate. User acknowledges that MyVirtual Network does not control such websites, and is not responsible for their content. Users further acknowledge that use of any website controlled, owned or operated by third parties is governed by the terms and conditions of use for those websites, and not by MyVirtual Network.
NOTICE OF TRADEMARK RIGHTS: "MyVirtual Network", "Mi Red Virtual" and the Digital Eye Logo are registered trade marks owned by MyVirtual Network L.L.C. Users may not copy or use any of these marks, logos or trade names without the prior written permission of MyVirtual Network.
NON-SOLICITATION: The Site and related services may not be used by any person to solicit, advertise, or contact in any form Users for employment, or any other purpose for a business not affiliated with MyVirtual Network without express written permission. Should MyVirtual Network find that you violate the terms of this section or any terms stated herein, MyVirtual Network reserves the right to terminate your use of this Site at its sole discretion at any time, and further reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
WHEN YOU SUBSCRIBE TO A REMOTE ACCESS SERVICE PLAN
YOU AGREE TO AND ACCEPT THE FOLLOWING TERMS & CONDITIONS:
PAYMENT(S): Subscriber agrees and authorizes MyVirtual Network L.L.C. to use the credit/debit card specified by the Subscriber for credit/debit payments for all purchases and monthly or annual charges for Remote Access. All accounts will be charged on the first of the month (exclusive of the first monthly payment) for twelve (12) consecutive months. If an account is put in service during a partial month as in the first month of service, charge(s) will be pro-rated and added to the next first of the month charge. Billing for Remote Access Service shall commence on the day after delivery by UPS (verification of delivery required).
DEFAULT: If a Subscriber fails to make any payment due for Remote Access when charged and does not within fifteen (15) days of the default including a ten ($10) dollar service charge, service may be suspended or terminated. If service is suspended or terminated Subscriber may reinstate service by paying all monies due plus a ten ($10) dollar reconnection fee.
TERM and AGREEMENT RENEWAL: The term of this Agreement shall be for a period of one (1) year and shall commence the day after delivery (UPS verification required). There after; this Agreement shall be automatically renewed each year provided: A) MyVirtual Network L.L.C. notifies Subscriber at least fifteen (15) days before the Agreement is to expire that the Agreement will be automatically renewed. B) MyVirtual Network L.L.C. notifies Subscriber of any renewal price changes. C) Subscriber does not notify MyVirtual Network L.L.C. in writing that Subscriber wants to cancel the Agreement prior to the renewal price changes, if any, and Subscriber agrees to pay MyVirtual Network L.L.C. prevailing rates at the time of renewal.
INDEMNIFICATION: In the event any person not a party to this Agreement shall make any claim or file any lawsuit against MyVirtual Network L.L.C arising from the negligent performance or failure to perform obligations under this Agreement, Subscriber aggress to indemnify, defend and hold MyVirtual Network L.L.C., its employees, agents, and contractors harmless from any and all claims, third party claims, lawsuits and losses, including the payment of all damages, expenses, attorney fees and costs, whether these claims be based upon alleged intentional conduct, active or passive negligence, or strict product liability, on the part of MyVirtual Network L.L.C., agents, or employees.
LIMITATION OF LIABILITY: Subscriber acknowledges that MyVirtual Network's liability under this Agreement is limited, and Subscriber agrees that should there arise any liability for loss or damage from a failure by MyVirtual Network L.L.C. to perform any of its obligations, MyVirtual Network's liability shall be limited, and MyVirtual Network L.L.C. under no circumstances shall be required to pay Subscriber more than, Two Hundred and FIFTY ($250) Dollars.
FULL AGREEMENT; SEVERABILITY: This Agreement is the full understanding of the parties, and there are no oral agreements, understanding or representations between the parties. Should any provisions of this agreement be deemed void, the remaining provisions shall remain in full force and effect. This Agreement is governed by the laws of the State of New York.
